Social policy and labour mobility in Europe -the gap between law and enforcement

In this contribution, the author reflects on the gap between EU social policy Regulations and Directives related to cross-border labour mobility and the problems that legal and social practitioners encounter in the application of this regulatory frame. He assesses some basic fields of social policy and workers' rights applicable in the area of labour mobility (free movement, posting of workers, coordination of social security) to demonstrate the disparity between the 'spirit of the law' and the practical application of the legislation. This gap is often stemming from contradictions that are the result of the subordination of social rights to the economic freedoms. Política social e mobilidade laboral na Europa-o hiato entre a lei e a sua aplicação Resumo Neste artigo, o autor reflete sobre a disparidade entre os regulamentos e diretivas da UE em matéria de política social relacionados com a mobilidade laboral transfronteiriça e os problemas que os profissionais do direito e da justiça encontram na aplicação deste quadro regulamentar. Avalia alguns domínios fundamentais da política social e dos direitos dos trabalhadores aplicáveis no domínio da mobilidade laboral (livre circulação, destacamento de trabalhadores, coordenação da segurança social) para demonstrar a disparidade entre o "espírito do direito" e a aplicação prática da legislação. Esta lacuna resulta frequentemente de contradições que resultam da subordinação dos direitos sociais às liberdades económicas. Dans cet article, l'auteur réfléchit sur l'écart entre les règlements et directives de politique sociale de l'UE relatifs à la mobilité transfrontalière de la main-d'oeuvre et les problèmes que rencontrent les professionnels juridiques et sociaux dans l'application de ce cadre réglementaire. Il évalue certains domaines fondamentaux de la politique sociale et des droits des travailleurs applicables dans le domaine de la mobilité de la main-d'oeuvre (libre circulation, détachement des travailleurs, coordination de la sécurité sociale) pour démontrer la disparité entre l'"esprit du droit" et l'application pratique de la législation. Cet écart est souvent le résultat de contradictions qui résultent de la subordination des droits sociaux aux libertés économiques.

Intra-European mobility is directly connected to the transfer of social security rights for mobile EU citizens within the framework of the EU’s social security coordination system. In fact, the portability of social security is a central factor in enabling and guaranteeing free movement between mobility-sending countries and mobility-receiving countries and thus contributes to the realization of a European labour market. Portability of social security rights involves the recognition and transfer of entitlements, which, rather than being a straightforward process, creates barriers for mobile EU citizens who are required to meet complex regulatory and institutional conditions. The goal of the TRANSWEL project was to analyse the portability of social security rights with regard to its regulations, practices and limitations by comparing patterns of post-enlargement labour mobility between four EU country pairs: Hungary–Austria, Bulgaria–Germany, Poland–United Kingdom and Estonia–Sweden. Focusing on the transitional state of Bulgaria and the conservative welfare state of Germany, this paper presents an analysis of institutional regulations with respect to the portability of social security rights in four areas: unemployment, family-related rights, healthcare and pensions. Building on interpretative policy analysis and expert interviews, the research revealed that the portability of benefits concerning statutory pensions and healthcare is to a large extent clearly regulated, whereas regulations in the areas of unemployment and family-related benefits remain largely obscure. In sum, the analysis identified three most significant barriers to portability: a high level of discretion in some policy fields, differences between national security systems and the organization of information exchange between countries.

Using the comparative analysis method of the national social security systems in the Member States, we propose to identify the minimum social elements common to the social systems so that, regardless of the worker's residence, the social protection of the worker is ensured as a right guaranteed for employees for the work done.

The coordination of the national social security is one of the crucial fields of cooperation between EU Member States. The coordination is based on the principle of application of one legislation at a time in cases of employment being executed in one or more than one Member State. Persons moving within the EU are thus subject to the social security scheme of only one Member State. The rules aim to guarantee equal treatment and non discrimination by the application of the lex loci laboris-principle. In 2004 the European legislator concluded modernised social security coordination rules (Regulation EC 883/2004) in order to simplify the current rules. The Implementing Regulation (Regulation EC 987/2009) was concluded in April 2009. The new rules came into effect from 1st May 2010.
